Terms of Service
Welcome to Gloss Guide, a two-sided marketplace connecting beauty service providers ("Providers") with clients ("Consumers"). By accessing or using our platform, you agree to comply with these Terms of Service ("Terms"). If you do not agree, please do not use Gloss Guide.
1. Acceptance of Terms
1.1 By using Gloss Guide, you confirm that you:
- Are at least 18 years old or have parental/guardian consent.
- Accept these Terms and our Privacy Policy.
- Acknowledge that additional policies (e.g., Cancellation Policy) may apply.
1.2 These Terms are governed by Australian Consumer Law (ACL) and other Commonwealth laws.
2. Account Registration
2.1 All users must provide accurate and current information.
2.2 Gloss Guide reserves the right to:
- Review and suspend accounts suspected of falsifying information.
- Request identity verification if needed.
2.3 You are responsible for maintaining account security (e.g., passwords).
3. Bookings & Payments
3.1 Consumers:
- Payments are processed securely (PCI DSS compliant).
- Pricing is set by Providers but must comply with ACL (no hidden fees).
3.2 Providers:
- Must accurately represent services, pricing, and availability.
- Must not engage in misleading or deceptive conduct (per ACL).
3.3 Refunds:
- Chargebacks are resolved per the ePayments Code (AU).
4. Cancellations & Refunds
4.1 Cancellation Policy:
- Consumers must cancel at least 24 hours prior for a full refund.
- Providers may set their own cancellation policies (must be clearly stated).
4.2 No-shows:
- Providers or Gloss Guide may charge a fee if a Consumer fails to attend without notice.
5. Liability & Disclaimers
5.1 Gloss Guide is a marketplace only and does not:
- Guarantee the quality, safety, or legality of services provided.
- Employ or supervise Providers (they are independent contractors).
5.2 Providers are encouraged to hold public liability insurance.
5.3 Consumers assume responsibility for:
- Allergic reactions (patch tests recommended).
- Verifying Provider credentials (e.g., qualifications, hygiene standards).
6. Intellectual Property
6.1 Providers retain ownership of their content (e.g., photos, service descriptions) but grant Gloss Guide a non-exclusive license to display it.
6.2 Unauthorised use of trademarks, logos, or copyrighted material is prohibited (Copyright Act 1968).
7. Privacy & Data Protection
7.1 Gloss Guide complies with the Privacy Act 1988 (including APPs).
7.2 Personal data is used for:
- Facilitating bookings.
- Marketing (opt-out available).
7.3 Data breaches are reported per the Notifiable Data Breaches (NDB) scheme.
8. Prohibited Conduct
8.1 Users must not:
- Offer illegal/unprofessional services (e.g., unlicensed treatments).
- Discriminate under the Australian Human Rights Commission Act 1986.
- Post fake reviews or engage in misleading conduct (ACL breaches).
9. Termination & Suspension
9.1 Gloss Guide may suspend or terminate accounts for:
- Fraud, harassment, or breaches of these Terms.
- Violations of Australian law.
9.2 Users may appeal suspensions via a fair review process.
10. Dispute Resolution
10.1 Step 1: Notify Gloss Guide of the dispute via [contact email].
10.2 Step 2: If unresolved, disputes may be escalated to:
- The Australian Competition & Consumer Commission (ACCC).
- Relevant state/territory consumer affairs agencies.
11. Governing Law

12. Changes to These Terms
